About Procedural Fairness & Inadmissibility
A procedural fairness letter is IRCC’s warning that it is about to refuse your application — and often to find that you misrepresented something. You are given a short deadline, frequently 30 days or less, to respond. A misrepresentation finding carries a five-year ban from Canada and follows you into every future application, so the response is the most important document you will ever file.
Inadmissibility takes several forms: criminal convictions inside or outside Canada, medical conditions that could burden the health system, security and organized-crime concerns, financial inadmissibility and misrepresentation. Each has its own remedy — criminal rehabilitation, a temporary resident permit, a medical response with specialist evidence, or an application on humanitarian and compassionate grounds — and each has to be argued, not just filled in.
This is lawyer’s work, and at FRBD it is done by our in-house counsel together with the immigration practitioner who knows how officers read a file.
Who it is for
- Anyone who has received a procedural fairness letter about misrepresentation, a genuineness concern, finances or a document IRCC questions.
- Applicants with a criminal record, including impaired driving, who need criminal rehabilitation or a temporary resident permit.
- Applicants or family members with a medical condition flagged as excessive demand.
- People in Canada without status, or with a removal order, who may qualify on humanitarian and compassionate grounds.
Requirements at a glance
- Procedural fairness letter: a response within the deadline, with evidence — not just an explanation — for every concern raised.
- Criminal rehabilitation: five years since the end of the sentence (deemed rehabilitation for a single minor offence after ten years).
- Temporary resident permit: a compelling reason to enter or stay that outweighs the risk.
- Humanitarian and compassionate application: establishment in Canada, the best interests of any children, hardship and family ties, documented in detail.
- Medical inadmissibility: a mitigation plan or specialist evidence that the cost or demand threshold is not met.
How FRBD helps
- Emergency turnaround on procedural fairness letters — we work to the deadline, not around it.
- Access-to-information requests for the officer's notes so the response answers the real concern.
- Criminal rehabilitation, deemed rehabilitation opinions and temporary resident permits.
- Humanitarian and compassionate applications written as a narrative with evidence, including the best interests of the child.
- Challenges of misrepresentation and inadmissibility findings at the Federal Court.

Questions about Procedural Fairness & Inadmissibility
Read the letter: it states the deadline, commonly 30 days and sometimes as little as 7. Extensions are possible if requested before the deadline and justified. Do not send a quick reply — a thin response is treated as no response, and the refusal and misrepresentation finding follow.
You are inadmissible to Canada for five years from the date of the finding (or the date you leave Canada), and every later application must disclose it. Even an honest mistake or an error by a previous representative can be treated as misrepresentation. The time to fight it is before the finding is made.
Often, yes. Depending on the offence and how long ago the sentence ended, you may be deemed rehabilitated, you may apply for criminal rehabilitation, or you may need a temporary resident permit for a specific trip. An impaired-driving conviction is treated as serious criminality since 2018, so get advice before you travel.
People who would normally need to apply for permanent residence from outside Canada but have strong reasons to be allowed to apply from inside: years of establishment, children whose interests would be harmed, serious hardship on return, medical needs. It is discretionary and slow, and it is only as strong as its evidence.
