About Judicial Review
When an immigration officer, a visa office or the Immigration and Refugee Board refuses an application and there is no appeal, the remaining remedy is Judicial Review in the Federal Court. The Court does not decide your case again; it asks whether the decision was reasonable and whether the process was fair. If it was not, the decision is set aside and sent back to a different officer.
The deadlines are short and strict: 15 days from the decision for matters decided inside Canada, 60 days for decisions made outside Canada. The first step is an application for leave — written argument only — and most applications are decided at that stage. That is why the quality of the written record and the legal argument matters more than anything else.
FRBD’s in-house counsel, Sadaf Tahriri (LL.M., LL.B.), leads this work with Farbod Tahriri’s immigration analysis. Together they have taken refused study permits, work permits, visitor visas, permanent residence applications, Start-Up Visa files, sponsorships and refugee decisions to the Court.
Who it is for
- Applicants refused a visa, permit or permanent residence where the officer ignored evidence, applied the wrong test or gave no real reasons.
- Refugee claimants refused by the Refugee Protection Division or the Refugee Appeal Division.
- Sponsors and applicants refused on misrepresentation or inadmissibility findings.
- Anyone who received a negative decision in the last 15 days (inside Canada) or 60 days (outside Canada) — or slightly longer, if there are grounds for an extension of time.
Requirements at a glance
- A final decision with no further administrative appeal, or an appeal that has been exhausted.
- The refusal letter and, as soon as possible, the officer's full notes (we request them immediately).
- An arguable error: unreasonable findings, ignored evidence, a breach of procedural fairness, or a misreading of the law.
- Action within the deadline — 15 or 60 days — or a credible explanation for the delay.
How FRBD helps
- A same-week review of the refusal and the officer's notes with an honest opinion on the chances.
- The application for leave, the affidavit and the memorandum of argument drafted by counsel.
- Negotiated settlements where the Department of Justice agrees to re-determine the case without a hearing.
- Representation at the hearing if leave is granted.
- The re-determination itself: a stronger application for the new officer, so the win is not wasted.
Federal Court deadlines and procedure verified on November 2, 2026.

Questions about Judicial Review
An appeal — for example to the Immigration Appeal Division for some sponsorship and residency cases — re-hears the case and can substitute its own decision. A Judicial Review only checks whether the original decision was reasonable and fair. Most visa and permit refusals have no appeal, so Judicial Review is the only route.
Leave is usually decided within four to six months of filing. If leave is granted, the hearing follows within a few months, and a successful outcome sends the file back to IRCC for a new decision. Many cases settle earlier when the Department of Justice sees a weak decision.
Winning means the refusal is set aside and a different officer must decide again, usually with directions from the Court. It is not a guarantee of approval, which is why we prepare the re-determination package as carefully as the court file.
Judicial Review is priced after we have read the decision, because the amount of work depends on the record. The initial review is part of our consultation. We do not take cases we think will lose.
