About Refugee Claims & Appeals
Canada protects people who face persecution because of their race, religion, nationality, political opinion or membership in a particular social group — including gender and sexual orientation — and people who face a risk of torture, death or cruel treatment if returned. A claim is made at a port of entry or inside Canada, and the Refugee Protection Division of the Immigration and Refugee Board decides it at a hearing.
A refugee claim is won on preparation: a Basis of Claim narrative that is detailed, consistent and supported by country-condition evidence and personal documents, and a claimant who has been prepared for the hearing. It is lost on contradictions, late documents and representatives who treat it as a form. Claims from countries with large Canadian communities — Iran, Türkiye, Afghanistan, Russia, Nigeria and others — are decided on the specifics of the person, not the country.
FRBD’s in-house counsel and our immigration team prepare the claim together, represent you at the hearing, and if the claim is refused, take it to the Refugee Appeal Division and, where necessary, the Federal Court.
Who it is for
- People in Canada — on a visitor visa, study or work permit, or without status — who cannot safely return home.
- Claimants at a port of entry who need representation before their eligibility interview and hearing.
- Claimants whose hearing is scheduled and whose current representative is not preparing them.
- Refused claimants within the deadline to appeal to the Refugee Appeal Division or to seek Judicial Review.
Requirements at a glance
- Eligibility to make a claim in Canada: generally no previous claim in Canada, no protection in another country and no exclusion under the Safe Third Country rules.
- The Basis of Claim form within 15 days of a port-of-entry referral (inland claimants complete it before the eligibility interview).
- Identity documents and evidence of the persecution or risk: reports, medical records, witness statements, country conditions.
- Appeal to the Refugee Appeal Division: notice of appeal within 15 days of the written reasons and the appeal record within 45 days.
- Judicial Review of a negative decision: application for leave within 15 days.
How FRBD helps

Questions about Refugee Claims & Appeals
Claimants whose claim has been referred to the Refugee Protection Division can apply for an open work permit and are covered by the Interim Federal Health Program while the claim is pending.
Scheduling varies with the Board’s backlog and the country of claim; in 2026 many claims waited more than a year. We use that time to build the evidence, not to wait.
Most refused claimants can appeal to the Refugee Appeal Division — a paper appeal with a 15-day notice deadline — and the Division can allow the claim, order a new hearing or confirm the refusal. If there is no right of appeal, or the appeal fails, the next step is Judicial Review at the Federal Court. A pre-removal risk assessment and a humanitarian application may also be available later.
We take claims we believe have merit, from any country, after reviewing the facts in a consultation. We do not take claims we think will fail, and we say so.
